These Terms of Service (“Terms”) apply to the use of the Express Drop website and to consumer orders placed with Express Drop, operated by Express Drop LTD (“Express Drop”, “we”, “us” or “our”).

Please read these Terms before placing an order. By placing an order through our website, you agree to be bound by these Terms together with any policies referred to below.

Nothing in these Terms limits or excludes any statutory rights that cannot lawfully be limited or excluded.

Our registered office is not open for customer collections or walk-in purchases.

2. Who may use our store

You must be legally capable of entering into a binding contract to place an order with us.

Some products sold by Express Drop are subject to legal age restrictions. You must satisfy the applicable minimum age requirement for any age-restricted product you purchase.

You must not purchase an age-restricted product on behalf of a person who is not legally permitted to purchase or receive that product.

3. Age-restricted products

Express Drop operates age-verification measures for applicable age-restricted products.

Depending on the product, order and delivery method, we may require age verification during checkout, before dispatch or at delivery.

You may be asked to provide acceptable evidence of age. We may refuse, suspend or cancel the supply of an age-restricted product where the applicable legal age requirement or our reasonable age-verification requirements are not satisfied.

Any refund due following such cancellation will be handled in accordance with applicable law and our policies.

4. Product availability

All products are subject to availability.

Adding an item to your basket does not reserve stock.

Occasionally, stock information may be inaccurate or an item may become unavailable after an order is submitted. If we cannot supply an item, we will contact you and provide an appropriate refund for any amount already paid for that item.

5. Product information and images

We take reasonable care to ensure that product descriptions, images, specifications and other information are accurate.

Packaging, colours, artwork and minor product details may occasionally differ from images shown where a manufacturer changes its packaging or presentation without materially changing the product.

Any material product characteristics required by law will be provided before purchase.

Nothing in this section affects your rights where goods are not as described or otherwise fail to conform to the contract.

6. Prices

Prices displayed on the website are the prices applicable to the relevant retail product at the time shown, subject to correction of genuine errors.

Any applicable delivery charge will be shown before you complete checkout.

Where applicable, taxes will be handled and displayed in accordance with the legal and tax requirements applying to the transaction.

We may change prices for future orders at any time. A price change will not normally affect an order for which a contract has already been formed.

7. Obvious pricing or listing errors

We take reasonable care when publishing prices and product information, but genuine errors may occasionally occur.

If an obvious and genuine pricing or listing error is identified before we accept or fulfil an order, we may contact you to explain the error and offer you the opportunity to proceed at the correct price where appropriate, or cancel the affected item or order and refund any amount already paid.

Nothing in this section permits us to alter an agreed price arbitrarily after a binding contract has been formed.

8. Placing an order

When you submit an order, you are making an offer to purchase the goods in your basket.

You are responsible for checking the products, quantities, delivery details and other order information before submitting your order.

After you place an order, we may send an acknowledgement confirming that we have received it. An acknowledgement of receipt does not necessarily mean that your order has been accepted.

9. When the contract is formed

Unless we expressly tell you otherwise, a contract for the sale of goods is formed when we accept your order, for example by confirming acceptance or dispatching the goods.

We may decline an order before acceptance for a legitimate reason, including lack of stock, inability to verify required information, inability to deliver to the supplied address, failure of an applicable age-verification requirement, suspected fraud or where supplying the order would be unlawful.

If we decline an order after payment has been taken, we will refund the amount due.

10. Payment

The payment methods available for an order will be displayed at checkout or otherwise agreed with you before the order is completed.

Depending on eligibility and availability, these may include card or other electronic payment services, bank transfer and cash on delivery.

Electronic payments may be processed by third-party payment providers. Express Drop does not ask customers to send card details through our contact form, email or WhatsApp.

You must provide accurate payment information and be authorised to use the payment method selected.

11. Bank transfer

Where bank transfer is offered, your order may remain unpaid and unconfirmed until cleared funds are received.

Please use the payment reference provided to you where applicable.

We will never ask you to send money to a different bank account solely because of an unexpected email or message. If you receive unusual payment instructions, contact Express Drop using the contact information published on our website before making payment.

12. Cash on delivery

Cash on delivery is available only where expressly offered for the particular order or delivery area.

Where cash on delivery is selected, payment must be made in accordance with the instructions provided for that delivery.

We may restrict or withdraw cash-on-delivery availability for future orders where there have been repeated refused, failed or unpaid deliveries, provided we act fairly and lawfully.

13. Order checks and fraud prevention

We may carry out reasonable checks to protect customers and Express Drop against fraud, unauthorised transactions and unlawful sales.

We may contact you to verify information relating to an order where reasonably necessary.

We will not require you to provide full payment-card details by email, contact form or WhatsApp.

14. Delivery

Available delivery methods, charges and estimated delivery times are explained in our Delivery & Shipping Policy and, where applicable, at checkout.

Delivery dates and times are estimates unless we expressly agree a guaranteed delivery service.

You are responsible for providing an accurate and complete delivery address and appropriate contact details.

No customer collection or click-and-collect service is currently offered from our registered office.

15. Risk and ownership

For consumer orders, responsibility for the goods passes to you in accordance with applicable law, including the rules governing when goods come into the physical possession of you or a person identified by you to take possession of them.

Ownership of goods will not pass to you until we have received payment in full where payment is required before ownership transfers.

16. Cancellation and change-of-mind returns

Consumers purchasing online may have a statutory right to cancel eligible orders within the applicable cancellation period.

Our Returns & Refunds Policy explains the cancellation period, how to notify us, return requirements, exclusions that may apply to certain goods, return postage and refunds.

Nothing in these Terms removes a statutory cancellation right where one applies.

17. Faulty, damaged or misdescribed goods

Goods must meet the standards required by applicable consumer law, including being of satisfactory quality, fit for purpose where applicable and as described.

If goods are faulty, damaged, incorrect or misdescribed, please contact us.

Your rights relating to faulty or non-conforming goods are separate from any change-of-mind cancellation rights.

18. Sealed and hygiene-sensitive goods

Certain statutory exceptions to change-of-mind cancellation rights may apply to particular sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed.

Whether an exception applies depends on the particular product and circumstances. We do not treat every vape or smoking-accessory product as automatically excluded from cancellation rights.

These exceptions do not remove rights you may have where goods are faulty, damaged, misdescribed or otherwise fail to conform to the contract.

19. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions communicated with the relevant offer.

Unless stated otherwise, promotional offers cannot be exchanged for cash and may not be combinable with other promotions.

We may refuse the use of a promotion where it has expired, its clearly stated eligibility conditions are not satisfied, or there is reasonable evidence of fraud or abuse.

We will not retrospectively alter a promotion already validly applied to an accepted order except where required by law or agreed with you.

20. Website availability

We aim to keep our website available and functioning correctly, but uninterrupted access cannot be guaranteed.

We may temporarily suspend or restrict parts of the website where reasonably necessary for maintenance, security, technical issues or legal compliance.

This does not affect obligations relating to orders already accepted.

21. Acceptable use of the website

You must not knowingly misuse the website, attempt unauthorised access, introduce malicious code, interfere with its operation, use it for unlawful activity or attempt to circumvent security or age-verification measures.

Automated activity that materially disrupts the website or attempts to obtain unauthorised access is prohibited.

22. Intellectual property

The Express Drop name, branding, website design, original graphics, original photographs, written content and other materials created by or for Express Drop may be protected by intellectual-property rights.

You may use the website for your personal, lawful shopping purposes.

You must not reproduce, republish, commercially exploit or falsely present our protected original content as your own without permission, except where applicable law permits such use.

Third-party product names, logos, trademarks and other intellectual property remain the property of their respective owners.

23. Reviews and customer-submitted content

If you submit a review or other content to us, you must not knowingly submit content that is unlawful, fraudulent, defamatory, threatening, infringes another person's rights or contains malicious material.

Where you provide content for publication, you grant us permission to display and use that content for the purposes for which it was submitted, subject to applicable law and our Privacy Policy.

We may moderate or remove submitted content where reasonably necessary for legal, security or platform-integrity reasons.

24. Our responsibility to consumers

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

In particular, nothing in these Terms is intended to exclude or restrict liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to goods.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses that were not reasonably foreseeable, except where the law provides otherwise.

25. Personal use and business losses

These consumer Terms are intended for customers purchasing wholly or mainly for purposes outside their trade, business, craft or profession.

If you are purchasing wholly or mainly for business purposes, the applicable Express Drop Trade/B2B terms may apply instead.

Nothing in this section removes rights that cannot lawfully be excluded.

26. Events outside our reasonable control

We will not be responsible for a delay or failure caused by circumstances outside our reasonable control to the extent permitted by law.

Where such an event materially affects an accepted order, we will take reasonable steps to minimise the effect and communicate with you where appropriate.

Your statutory rights, including rights that may arise from significant delivery delays, are not excluded by this section.

27. Privacy and cookies

We process personal information in accordance with our Privacy Policy and applicable data-protection law.

Information about cookies and similar technologies is provided through our privacy and cookie information and the consent controls made available on the website where applicable.

28. Changes to these Terms

We may update these Terms from time to time to reflect changes to our business, website, services or legal obligations.

The Terms applicable to an order will normally be those in effect when the relevant contract is formed, unless a change is required by law or is otherwise validly agreed.

We will not use this section to make arbitrary retrospective changes to an existing consumer contract.

29. If part of these Terms is unenforceable

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

30. No waiver

If we do not immediately enforce a right or remedy available to us, that does not necessarily mean we have waived that right or remedy.

31. Governing law and disputes

These Terms and consumer contracts with Express Drop are governed by the applicable laws of England and Wales, subject to any mandatory protections available to consumers under the law that applies to them.

If you are a consumer resident elsewhere in the United Kingdom, nothing in these Terms deprives you of mandatory protections or rights to bring proceedings in a court available to you under applicable law.

If a problem arises, please contact us first so that we have an opportunity to resolve it.

32. Trade and B2B customers

These Terms primarily govern consumer retail purchases.

Approved trade customers and purchases made wholly or mainly for business purposes may be subject to separate Express Drop Trade Terms & Conditions, Trade Returns Policy, catalogue pricing, payment terms and delivery arrangements.

Where separate trade terms have been validly incorporated into a B2B transaction, those terms will apply to that transaction to the extent stated.
